These Terms and Conditions (“Terms”) govern your use of the website at mountains2metal.com (the “Website”), your purchases through it, and the text messaging program described below (the “SMS Program”). The Website and the SMS Program are operated by Barnes Metalcrafters, Inc., doing business as Mountains2Metal (“Mountains2Metal,” “M2M,” “we,” “us” or “our”). By using the Website, placing an order or joining the SMS Program, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or the SMS Program.
1. Who we are
Mountains2Metal designs and builds American-made accessories for the Ford Bronco and for Ford, Chevrolet, GMC and Jeep trucks, and also sells products from other brands. We are a division of Barnes Metalcrafters, Inc., located at 2121 Industrial Park Drive SE, Wilson, NC 27893. You can reach us at (252) 360-4034 or sales@mountains2metal.com.
2. Using the Website
You must be at least 18 years old, or the age of majority where you live, to create an account or place an order. You agree to use the Website only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access to it, or submit false information or harmful content through its forms.
If you create an account, you are responsible for keeping your password confidential and for activity under your account. Tell us right away if you think someone has used your account without permission.
3. Products, orders and pricing
Product information. We try to describe and photograph our products accurately, but colors, finishes and details may vary slightly from what you see on screen, and descriptions may contain errors. Items in our SAD (Scratch & Dent) category have cosmetic flaws and are sold as described on their product pages.
Orders. Your order is an offer to buy. We may accept or decline it, and an order is accepted when we ship it. We may limit quantities, and we may cancel an order, with a full refund of any amount charged, if a product is unavailable, if there is an error in its price or description, or if we suspect fraud.
Prices and payment. Prices are listed in U.S. dollars and do not include shipping charges or applicable sales tax, which are shown at checkout. Prices and availability may change without notice. You authorize us and our payment processors (Authorize.Net and PayPal) to charge your chosen payment method for the total shown at checkout.
Custom orders. Custom work is quoted separately, and the price, specifications and timing we agree with you in writing apply to it.
4. Shipping, returns and exchanges
Shipping times, international orders, returns, exchanges, restocking fees and refunds are covered by our Shipping & Returns policy, which is part of these Terms. If anything in these Terms conflicts with that policy on those topics, the Shipping & Returns policy controls. As that policy explains, orders shipped to Canada or anywhere outside the 48 contiguous U.S. states may be subject to additional customs fees, which the recipient pays and which are not included in the shipping charge.
Some orders offer optional shipping protection through Route. If you choose it, the protection is provided by Route under its own terms, and claims are handled through Route.
5. Fitment, installation and safe use
Before ordering, check that a product fits your vehicle’s make, model, year and trim, as stated on its product page. Install products according to our instructions; if you are not comfortable doing the work yourself, have a qualified installer do it. You are responsible for safe installation and use, for loading and securing cargo within the product’s and your vehicle’s limits, and for following the laws where you drive, including laws about lighting, visibility and equipment on public roads. Installing aftermarket parts may affect your vehicle manufacturer’s warranty.
6. Warranties
Any warranty for a product is the written warranty, if any, stated on its product page or included with the product. Products from other brands are covered by their manufacturers’ warranties. Except for those written warranties, and to the fullest extent permitted by law, products are sold without other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. Some states do not allow limits on implied warranties, so this may not apply to you, and you may have other rights that vary by state.
7. Reviews and other content you send us
When you post a product review, send us photos or submit other content, you confirm that it is accurate, that it is yours to share, and that it does not violate anyone’s rights. You give us a non-exclusive, royalty-free, perpetual license to use, reproduce, display and adapt it, along with the name you provide, on the Website, in our marketing and on social media. We may decline or remove any content. Reviews collected through Shopper Approved are also subject to Shopper Approved’s terms.
8. SMS messaging program
Program description. Mountains2Metal sends recurring marketing text messages to people who opt in, such as news about new products, sales, offers and store updates. We send these messages through our email and SMS provider, Mailchimp.
How you opt in. You join the SMS Program by entering your mobile number in one of our sign-up forms and checking the box (or otherwise expressly agreeing) to receive marketing text messages from Mountains2Metal. Consent to receive promotional text messages is not a condition of buying any goods or services from us.
Message frequency. Message frequency varies, typically up to a few messages per month.
Costs. Message and data rates may apply. Check your mobile plan for details. We do not charge for text messages.
How to opt out. Reply STOP to any message to stop receiving text messages from us. We will send one message confirming that you have been unsubscribed, and then you will receive no further messages unless you opt in again. Help. Reply HELP to any message for help, or contact us at (252) 360-4034 or sales@mountains2metal.com.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery of messages is not guaranteed.
Your number. You confirm that you are the account holder or an authorized user of the mobile number you provide, and you agree to tell us if you give up or change that number.
Privacy. We do not sell, rent or share your mobile number or SMS opt-in consent with third parties or affiliates for their marketing purposes. See our Privacy Policy for details.
9. Affiliate program
Our M2M Affiliates program is run through GoAffPro. Joining it is subject to the program’s own terms, which we provide when you sign up.
10. Intellectual property
The Website and its content, including text, photos, videos, product designs, logos and graphics, belong to Barnes Metalcrafters, Inc. or its licensors. You may view and share pages for your own non-commercial use, but you may not copy, modify or republish the content for commercial purposes without our written permission. Mountains2Metal, M2M and our logos are trademarks of Barnes Metalcrafters, Inc.
Ford, Bronco, Chevrolet, GMC, Jeep and other vehicle names, and the names of other brands we sell, are trademarks of their owners. We use them only to describe which vehicles our products fit or which brands we carry. Mountains2Metal is not affiliated with or endorsed by those vehicle manufacturers.
11. Links to other websites
The Website links to and embeds content from other services, such as YouTube, Vimeo, Facebook, Instagram, Pinterest, Google Forms and Shopper Approved. We do not control those services and are not responsible for their content or practices. Their own terms and privacy policies apply when you use them.
12. Disclaimer
The Website is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind about the Website itself, express or implied, and we do not promise that it will be uninterrupted, error-free or free of harmful components.
13. Limitation of liability
To the fullest extent permitted by law, Barnes Metalcrafters, Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising from your use of the Website or any product bought through it, including damage caused by improper installation or misuse. Our total liability for any claim related to a product will not exceed the amount you paid for that product, and for any other claim related to the Website will not exceed one hundred U.S. dollars (US$100). Some states do not allow these limits, so they may not apply to you.
14. Changes to the Website or these Terms
We may change or discontinue the Website, or any product, at any time. We may also update these Terms. When we do, we will change the “Last updated” date above. The Terms in effect when you place an order apply to that order. Continuing to use the Website after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules. Any dispute about the Website or a purchase will be brought in the state or federal courts located in North Carolina. Before filing a claim, you agree to contact us first so we can try to resolve the issue informally.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy and Shipping & Returns policy, are the entire agreement between you and us about the Website and your purchases through it.
